The leasing of the site by the lessor Pleasant Bay Bible Conference Grounds Inc. “PBC” to the Lessee shall be in consideration for and subject to the following terms and conditions:

  • A one-year lease commencing on the 1st day of May, on the year indicated on the online Annual Trailer Lot Lease form, and expiring on the 31st day of April the following year.
  • The PBC Campground is open for seasonal recreational use by the Lessee and their visitors beginning on 1st day of May and ending on the 31st of October. This is considered the “ON-SEASON”.  Water and sewage will be available during the on-season as defined in the Campground Handbook.  Water service may be shut off prior to October 31st due to cold weather considerations but not earlier than the weekend after Thanksgiving weekend.  Ontario winters occasionally cause the delay of the turning on of water service.
  • Lessees may visit and/or occupy their trailer during the off-season at their discretion however, the following provisos apply:
    • Trailers are for seasonal use only, are not mobile homes, and cannot be used as a permanent or principal residence.
    • Lessees understand and agree that there will be absolutely no expectation of any services that are provided during the on-season, including available staff and they shall not contact camp staff unless there is an emergency.
    • Lessees agree that there shall be no expectation of any snow removal.
    • Black water (sewage/waste) dumps at the bathrooms are not to be used.
    • Any stay exceeding (7) seven nights shall be approved by the Board of Directors in advance.
    • The Lessee acknowledges that they have willingly assumed, without restriction, all risks arising out of their use of the site and the campground at PBC during the Off-Season.
  • Only one trailer may occupy the provided site at any given time.

The Lessee must:

  • Complete and return the online Annual Trailer Lot Lease form to the Family Camp Manager with the required annual fees no later than April 30th of the year indicated on the online Annual Trailer Lot Lease form.
  • Provide the Camp Manager with proof of valid trailer insurance against fire and storm damage, third party liability insurance for a minimum of $1,000,000.00, and rental insurance where applicable.
  • Maintain the trailer in good condition and equip it with an approved fire extinguisher, a fully functional smoke alarm, and a fully functional carbon monoxide alarm.

The Lessee acknowledges:

  • Their trailer is for seasonal use only, is not a mobile home, and cannot be used as a permanent or principal residence.
  • The Lease granted under these Terms and Conditions is a temporary, contractual, Lease only and not a tenancy agreement. This agreement and the Terms & Conditions granted hereunder do not confer any interest in the land to the lessee.
  • This Lease is for the occupation of the site specified only. 

That they are lessees with respect to any facilities assigned to them and are deemed to have willingly assumed, without restriction, all risks arising out of their use of the site and the Campground at PBC.

  • The online Annual Trailer Lot Lease form must be completed and returned to the Family Camp Manager no later than May 1st of the year stated on the form.
  • Lessees with any charges or payments overdue by 30 days will receive a reminder via email of the past due charges or payments.  A second such email will be sent if the account remains past due by 60 days.  At 75 days past due lessees will receive one phone call (a message will be left on voicemail if the lessee does not answer) reminding them of the past due amounts and the terms & conditions if the account reaches 90 days overdue.
  • Any charges or payments overdue by 90 days from the payment due date shall be charged interest at 10% of the total overdue.
    • Should an account remain in arrears beyond 6 months of the payment due date, the property on the lot is subject to removal & storage at PBC’s discretion, per the Terms & Conditions of the lease.  The Lessee indemnifies PBC from any loss or damage to property being removed/stored under these circumstances and all associated costs for removal & storage shall be invoiced to the Lessee. 
    • A fee of $50.00 will be charged on all NSF cheques
  • All payments are non-refundable unless noted otherwise and are held against the final balance owing in any year.  The payments are forfeited as liquidated damages and not as a penalty upon breach of any term of this agreement.  There shall be no adjustment of fees because of temporary interruptions of services provided.
  • The lease shall be renewed solely at the discretion of PBC.
  • In addition to the foregoing, the Lessee shall pay any taxes, assessments, levies, or licencing fees imposed by any authority on or because of any equipment, fixtures, improvements, furnishings, or vehicles erected, placed, or left on the site by or on behalf of the Lessee.
  • The Lessee hereby undertakes and agrees that he/she will inform any family members or visitors attending PBC as to the rules and regulations as published in the Campground Handbook and modified from time to time.   This must be communicated prior to their arrival.  The Lessee is responsible for the observance of the rules and regulations by family members and visitors attending PBC.
  • Failure to remit any payment required under the terms of this Agreement and any breach of any rules and regulations by the Lessee, their family members and visitors attending PBC shall be deemed to be a breach of this lease and this lease may be terminated at the option of PBC.
  • PBC assumes no responsibility for any loss through fire, theft, collision, or otherwise to trailers, additions, improvements, or vehicles or their contents, regardless of cause.  The Lessee agrees that the use of the campground or its facilities is solely at the risk of themselves, their family and visitors.  Executers, administrators, successors and assigns HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE PBC, its employees, agents, servants, successors and assigns OF AND FROM ALL CLAIMS, demands, damages, costs, expenses, actions and causes of action, whether in law or equity, in respect of death, injury, loss or damages to themselves, their family and visitors or their property HOWSOEVER CAUSED, arising or to arise by reason of occupation of the above mentioned site and use of the campground or otherwise, whether prior to, during or subsequent to this AND NOTWITHSTANDING that the same may have been contributed to or occasioned by the negligence of any of the aforesaid.  The Lessee further undertakes on their own behalf and on behalf of their family and visitors to indemnify all the aforesaid from and against all liability incurred by any or all of them arising because of or in any way connected with this lease.
  • Lessees must abide by all the terms and conditions of any applicable municipal, provincial, or federal laws and regulations, and failure to do so may be deemed to be by the Lessees, their family members and visitors with the Lessee’s permission, a breach of this lease.
  • In the event of any default of any of the terms and conditions of this lease, PBC shall have the following rights:
    • To disconnect services provided (hydro, water) to the lessee’s site
    • To revoke gate access
    • To assess fines or additional fees
    • To not renew annual site lease
    • To have a vehicle towed/impounded
    • On fourteen days prior written notice delivered, or deemed received under the terms of this lease, to re-enter upon the above site and repossess the site terminating the lease.
    • To bar the Lessee, their family members and visitors from accessing the recreational amenities and from staying past 8:00 pm on any day during the aforementioned fourteen days.
  • This lease is personal to the lessee and is not assignable or transferable.
  • Failure to comply with all rules and regulations in the Campground Handbook will result in a review of the lessee’s lease status and potential non-renewal of the Lease.
  • PBC has the authority to remove a trailer unit in case of emergency or in the event of non-payment of fees or non-compliance with rules and regulations.
  • In the event that this site shall be repossessed under the terms and conditions of this lease, any goods including any trailer that the lessee has left on the site shall be deemed to be an article defined by the Repair and Storage Liens Act of Ontario, (hereinafter referred to as “the Act”), may be removed by PBC, who shall be deemed to be a lien claimant, and stored under the Act, to/at whatever location PBC deems appropriate and PBC, in such removal and storage, will not be responsible for any loss or damage to such goods.  The lessee will be responsible for any storage costs and moving costs incurred, together with any outstanding fees or charges or any other monies due under this agreement and PBC may recover costs and/or monies owing in accordance with the provisions of the Act.
  • The lessee of a site shall exercise such care as is reasonable in the maintenance of the site during their occupancy to see that any persons entering on the site and the property brought on the site by those persons are reasonably safe while on the site and shall save PBC harmless from any claims because of the failure of the lessee to do so.  No add-ons, additions or site improvements shall be incorporated without prior written approval of the Family Camp Manager.  If such approval is granted, such ad-ons, additions, or improvements must be incorporated so as not to impede the expeditious vacating of the site and removal of the lessee’s property.
  • By their signing of this lease the lessee hereby represents and warrants that they have the responsibility and/or authority to sign on behalf of family members and any visitors attending at the site.
  • The lessee further agrees that while their trailer and equipment of any nature is on PBC’s premises, they will not hire or permit any person or any company, without adequate liability insurance to perform any labour; it being understood that PBC does not permit any labour or services to be performed on its premises without the express written permission of the Camp Manager.  The foregoing limitation is not intended to prevent the lessee or their family from doing such work provided such work is done in accordance with all pertinent laws and/or regulations and has been approved in writing by PBC.
  • The lease, including the Campground Handbook and these terms and conditions hereto, shall constitute the entire arrangement between the parties.  There is no representation, warranty, condition, or collateral agreement affecting this document other than as expressed here in writing.  The lease shall be read with all changes of gender and number required by the text.
